Changes to rental licence applications in Spain 2025
From April, new rules could affect your ability to rent out your property in Spain

Starting in April 2025, the Spanish government is introducing changes to rental licence applications that could have a significant impact on anyone looking to rent out their property as tourist accommodation.
The new rules will allow communities of owners to decide on whether or not to allow tourist rental apartments and properties to operate within the community.

What the new rules mean for property owners
One of the most important changes is that the community where your property is located will now have the power to decide whether tourist rentals are permitted. This decision will be made during the community’s next annual general meeting (AGM) whether or not to allow tourist rentals in the building or urbanisation. If the community votes to prohibit tourist rentals at the AGM – which could be anytime in the next 12 months, depending on the community – no new rental licence applications will be accepted.
Those who already have a tourist rental licence for their property can continue to rent it out, regardless of the community’s decision. However, if you sell your property after the community has voted to stop allowing tourist rentals, the new owner will not be able to apply for a licence.
For anyone who has not yet applied for a tourist rental licence, time is of the essence. If your community votes against rental properties and you haven’t applied, you will lose the chance to do so.
